1. Eligibility: You must be at least 18 years old (or have parental/guardian consent if under 18) to use our services. By using our website or services, you represent and warrant that you meet these requirements. 2. Services Provided: Dreamscape Co-op LLC provides: - Rehearsal Services – hourly or subscription-based use of rehearsal spaces. - Booking Services – promotion and event booking assistance. - Memberships – private membership access to opportunities and community benefits. - Partnerships – collaboration with local artists, venues, and service providers. We reserve the right to modify, suspend, or discontinue any service at our sole discretion. 3. Accounts and Memberships: Users may be required to create an account and provide accurate, current information. Membership access is non-transferable and may be revoked for violation of these Terms. You are responsible for maintaining the confidentiality of your account credentials. 4. Payment Terms: Payments may be processed via PayPal, Venmo, Stripe, or other listed processors. All fees are due at the time of booking, subscription, or membership purchase. Late or failed payments may result in suspension of access to services, late fees of $25.00 per day, and if necessary, legal collection of payment at your expense, Unless otherwise stated in a separate Refund/Cancellation Policy, all sales are final. 5. User Responsibilities: You agree not to: - Use the website or services for unlawful, fraudulent, or abusive purposes. - Damage, misuse, or remove equipment or property while using any of our services, including, but not limited to: rehearsal or booking services tools, equipment or property. - Share private membership content, opportunities, or materials without written consent and authorization of the owner. - Interfere with the operation of the website or services. -Attempt in any way to absuse, defraud, or illegally exploit any persons physically on our premises, or persons connected to our partners, off premises. 6. Intellectual Property: All content on this site, including logos, text, graphics, audio, video, and other materials, is owned by Dreamscape Co-op LLC or its partners. You may not copy, distribute, or reproduce any content without prior written permission. 7. Liability Disclaimer: Use of our services is at your own risk. Dreamscape Co-op LLC is not responsible for injuries, damages, lost equipment, or accidents occurring during use of rehearsal spaces or related services. To the maximum extent permitted by law, we disclaim all warranties, express or implied, regarding our website, services, and content. 8. Indemnification: You agree to indemnify, defend, and hold harmless Dreamscape Co-op LLC, its members, partners, and affiliates from any claims, damages, losses, or expenses arising out of your use of our services or violation of these Terms. 9. Termination: We reserve the right to suspend or terminate your access to our website, memberships, or services at any time, for any reason, including violation of these Terms. 10. Governing Law and Dispute Resolution: These Terms shall be governed by and construed in accordance with the laws of the State of South Carolina, USA. Any disputes shall first be attempted through informal resolution. If unresolved, disputes shall be resolved by binding arbitration in Richland, and/or surrounding counties, South Carolina, with all legal fees borne by the party bringing the claim, unless otherwise determined by the arbitrator. 11. Changes to These Terms: We may update these Terms from time to time. The updated Terms will be posted on our website with the new effective date. Continued use of our services after changes are posted constitutes acceptance of the updated Terms. 12: Independent Contractor Disclaimer: Dreamscape Co-op LLC may connect clients with independent contractors, including but not limited to sound engineers, photographers, "Roadies"(otherwise known as "tech", "stage hand," or "merch person"), videographers, booking agents, coaches, guest speakers, event service workers, or other service providers. These individuals are independent contractors and are not employees, agents, or representatives of Dreamscape Co-op LLC. Dreamscape Co-op LLC is not responsible for, and expressly disclaims any liability for, any acts, omissions, negligence, injury, death, damages, or losses caused by such independent contractors. All risks associated with services provided by independent contractors are assumed solely by the client and/or the contractor. Independent contracts are required to carry their own insurance, including but not limited to: General Liability Insurance, Professional Liability Insurance, and/or other insurances specific to the service they offer. 13. 1. Assumption of Risk: I acknowledge that participation in rehearsal, booking, membership, and any and all related services provided by Dreamscape Co-op LLC and their partners involves inherent risks, including but not limited to injury, accidents, property damage, or loss. I voluntarily assume all risks associated with participation in these activities. 2. Release of Liability: In consideration of being permitted to use the facilities and services of Dreamscape Co-op LLC, I hereby release, waive, discharge, and hold harmless Dreamscape Co-op LLC, its owners, members, partners, affiliates, independent contractors, and employees from any and all liability, claims, demands, or causes of action arising from participation in services, whether caused by negligence or otherwise. 3. Independent Contractors: I understand that Dreamscape Co-op LLC may connect me with independent contractors (such as sound engineers, photographers, or other service providers) who are not employees or agents of Dreamscape Co-op LLC. I agree that Dreamscape Co-op LLC is not responsible for the acts, omissions, or negligence of such contractors. 4. Indemnification: I agree to indemnify and hold harmless Dreamscape Co-op LLC, its members, contractors, and affiliates from any and all claims, damages, costs, or expenses (including attorney fees) arising out of my participation in services or caused by my actions while using the facilities or engaging with Dreamscape Co-op LLC in any way, their partnered independent contractors. 5. Medical Treatment I consent to receive necessary medical treatment in the event of injury or emergency and agree to be solely responsible for any medical costs incurred. 6. Governing Law: This Waiver and Release shall be governed by the laws of the State of South Carolina, USA. 7. Acknowledgement: I have read and fully understand this Waiver and Release of Liability. I understand that by signing, I am giving up substantial rights, including the right to sue Dreamscape Co-op LLC.
